Certain cases fall within Brimage Guidelines, based on State v. Brimage 153 N.J. 1 (1998). If your case is affected by the Brimage Guidelines, the prosecutor’s office will enhance your sentence based on factors such as:

  • Your prior criminal history
  • The amount of the drugs that were recovered
  • The location the drugs were found

Such an enhancement can result in a very significant prison sentence. For instance, if the alleged drug offense occurred within 1,000 feet of a school or within 500 feet of a public park or housing project, you will be in danger of a much longer period of incarceration than normal.

The Drug Court Program was established to help individuals overcome their addictions and substance abuse issues. Instead of jail time, individuals receive rehabilitation services and treatment.

If you successfully complete the program, the charges against you will be dismissed. Essentially, it will keep your background check clean. You will also be able to legally tell prospective employers, landlords and others that you have never been convicted of a crime.
